A Missouri DWI arrest can create a criminal case and a Department of Revenue driver-license action. For an over-limit Form 2385 action, the DOR provides an administrative-hearing route. An alleged refusal follows the separate RSMo 302.574 circuit-court petition route.

The DOR states that a written administrative hearing request for an over-limit Form 2385 action must be received or postmarked within 15 days after the notice date.
A refusal revocation is challenged through a petition for review in the circuit or associate division for the county where the arrest or stop occurred under RSMo 302.574.
